Preamble
These Terms and Conditions of Sale (hereinafter "T&Cs") apply to any reservation made with [ESTABLISHMENT NAME], [legal form] with share capital of [amount] euros, whose registered office is located at [full address], registered in the Trade and Companies Register of [city] under number [SIREN], intra-community VAT number [FR XX XXX XXX XXX] (hereinafter "the Establishment").
Any reservation implies the unreserved acceptance by the customer (hereinafter "the Customer") of these T&Cs, which prevail over any other document.
Article 1 - Purpose
The purpose of these T&Cs is to define the rights and obligations of the parties in connection with the reservation of accommodation services and ancillary services offered by the Establishment, whether by telephone, email, on site, or via the online booking website.
Article 2 - Reservation
2.1 The Customer selects the services presented on the booking website. The Customer acknowledges having reviewed the nature, purpose, and booking terms of the available services, and having sought and obtained the necessary information to make the reservation knowingly.
2.2 The Customer is solely responsible for their choice of services and for the suitability of those services to their needs, so that the Establishment's liability cannot be sought in this respect.
2.3 The reservation is deemed accepted by the Customer at the end of the booking process. The reservation is considered firm and final upon receipt by the Customer of a confirmation email sent by the Establishment, subject to availability.
2.4 The Customer guarantees the truthfulness and accuracy of the information provided. Any false statement may lead to the cancellation of the reservation at the Customer's expense.
Article 3 - Prices
3.1 Prices are displayed in euros, all taxes included, per room and per night, based on the number of occupants and the dates booked.
3.2 The tourist tax, collected on behalf of the municipality, is included or charged in addition as indicated at the time of booking.
3.3 Prices may be modified at any time without notice. Only the price communicated to the Customer at the time of booking confirmation applies to that reservation.
3.4 Additional services not mentioned in the booking confirmation (mini-bar, laundry, room service, etc.) will be invoiced separately and payable on site at check-out.
Article 4 - Payment terms
4.1 Payment is made according to the terms of the rate selected:
- Standard rate: credit card pre-authorisation at booking, payment on site at check-out.
- Non-refundable rate ("Prepaid"): full payment of the stay at booking.
- Rate with deposit: deposit paid at booking, balance paid on site.
4.2 Accepted payment methods are:
- Visa
- Mastercard
- American Express
- Cash (within the legal limits in force)
4.3 In case of payment default, the Establishment reserves the right to cancel the reservation without notice.
Article 5 - Cancellation and modification terms
5.1 Flexible rate
The Customer may cancel or modify the reservation free of charge up to [24/48/72] hours before the scheduled arrival date (local time of the Establishment). After this deadline, or in the event of a no-show, the first night will be charged as a flat-rate compensation.
5.2 Non-refundable rate
The non-refundable rate cannot be cancelled, modified, or refunded, regardless of the reason. The total amount of the stay is debited at booking and remains acquired by the Establishment.
5.3 Early departure
In the event of early departure, the entire reserved stay remains due.
5.4 Procedure
Any cancellation or modification request must be sent in writing (email) to the Establishment.
Article 6 - Arrival and departure
- Check-in: from 3:00 PM
- Check-out: before 11:00 AM
6.1 Any late check-out may result in an additional night being charged.
6.2 In case of late arrival (after 8:00 PM), the Customer is asked to inform the Establishment. Otherwise, and without news from the Customer by midnight, the reservation may be considered cancelled and the first night charged.
6.3 On arrival, the Customer must present a valid identification document, in accordance with French Decree No. 2015-1002 of 18 August 2015. A credit card pre-authorisation may be requested as a guarantee.
Article 7 - Capacity and minors
7.1 Rooms are intended for a maximum number of occupants indicated at the time of booking. The Establishment reserves the right to refuse access to rooms in case of overbooking.
7.2 Minors not accompanied by a legal representative are not admitted.
Article 8 - Pets
Pets are [allowed under conditions / not allowed]. If allowed, an additional charge of [amount] € per night applies. The Customer is liable for any nuisance or damage caused by their pet.
Article 9 - House rules and Customer liability
9.1 The Customer agrees to use the room and facilities peacefully and to respect the Establishment's house rules.
9.2 The Establishment is non-smoking. Any infringement will result in a flat-rate cleaning fee of [amount] €.
9.3 The Customer is liable for all damage caused by themselves or their companions. Any damage will be invoiced at the actual cost of repair or replacement.
9.4 The Establishment reserves the right to terminate the stay, without refund, in case of behaviour contrary to good morals, public order, or house rules.
Article 10 - Establishment's liability
10.1 The Establishment cannot be held responsible for the non-performance or poor performance of the reservation in case of force majeure, the act of a third party, or the act of the Customer.
10.2 In accordance with Articles 1952 et seq. of the French Civil Code, the Establishment's liability in case of theft or damage to objects deposited in the room is limited to the legal provisions. It is recommended that the Customer use the safe provided.
10.3 Photographs and descriptions presented on the website are given for information purposes only. Minor variations may exist without the Establishment's liability being engaged.
Article 11 - Personal data
11.1 Personal data collected is necessary for the processing of the reservation and the execution of the stay. It is processed in accordance with the General Data Protection Regulation (GDPR) No. 2016/679 and the amended French Data Protection Act.
11.2 The data controller is the Establishment. Data is kept for the time necessary to manage the contractual relationship, plus the legal retention periods.
11.3 The Customer has the following rights regarding their data:
- Right of access
- Right of rectification
- Right to erasure
- Right to restriction of processing
- Right to object
- Right to portability
- Right to define directives concerning the fate of their data after death
These rights can be exercised by post to the registered office or by email at [DPO email address].
11.4 The Customer also has the right to lodge a complaint with the French data protection authority (CNIL, www.cnil.fr).
Article 12 - Intellectual property
All elements of the booking website (texts, images, logos, trademarks) are the exclusive property of the Establishment or its partners and are protected by current intellectual property laws. Any reproduction is prohibited without prior written authorisation.
Article 13 - Complaints and mediation
13.1 Any complaint relating to the stay must be sent in writing to the Establishment within fifteen (15) days following the end of the stay.
13.2 In accordance with Articles L.611-1 et seq. of the French Consumer Code, the Customer may use, free of charge, the consumer mediation service designated by the Establishment.
13.3 The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Article 14 - Applicable law and jurisdiction
These T&Cs are governed by French law. In the absence of an amicable resolution, any dispute relating to their interpretation or execution will fall under the jurisdiction of the competent courts in accordance with the rules of common law.
